Frequently Asked Questions About Workers' Compensation

How do I know if I have a case?

You have a case if you were an employee injured doing your job. While being injured at work supports a claim of injury, it does not mean you will be entitled to benefits or that the case is viable. You should consult with an attorney about any claimed injuries.

Who is workers’ compensation for?

Workers’ compensation benefits, medical care and financial support, are for workers who were injured while doing their job. The severity of the injury does not matter, only that you were injured doing your job.

If I was hurt while remote working, traveling for work, or in a different state do I have a California Workers’ Compensation case?

Yes, depending on circumstances. California workers’ compensation can apply to a number of workplace injuries that do not happen on the jobsite or even in the state of California. A consultation with an attorney would be needed to provide an answer for your specific circumstances.

Do I need to hire a lawyer for my workers’ compensation injury?

No, but retaining a lawyer is recommended.

When should I hire a lawyer for my workers’ compensation case?

The sooner the better. Hiring a lawyer early in your case provides more time and opportunity for a lawyer to advantageously affect your case. Another major value of having an attorney is allowing them to monitor your case and prevent issues from arising rather than resolving them. The contingency fee structure of representation also means that it does not cost you more if the attorney works on your case longer. If you do delay in retaining counsel, you may limit a lawyer’s ability to help your case.

Does it matter if my lawyer is not a local attorney?

Yes, and hiring a local attorney is generally recommended. Most modern workers’ compensation representation can be done remotely. However, local attorneys tend to have advantages in their locality. Local attorneys usually have better knowledge of physicians in the area, have experience at your local court, and should be able to meet you in person without onerous travel.

Can a lawyer do anything about denied medical treatment?

Yes, but help with medical treatment denials is limited. A workers’ compensation attorney can appeal treatment denied by utilization review to independent medical review, but cannot go to court to overturn independent medical review decisions. An attorney also cannot generally go to court to force defendants to provide specific medical treatments.

What does it cost to hire you for workers compensation representation?

Nothing. We represent injured workers on a contingency fee basis, which means you never need to pay us for workers’ compensation representation. We are paid a percentage of what we recover from insurance for you.
